Terms of Service

These Terms govern your use of avarbockmed.com and the services offered there (the “Service”), operated by AvarbockMed LLC, a Florida limited liability company (“Avarbock Med”, “we”, “us”).
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Educational use only — not medical advice
The Service provides educational material for students and practitioners of medicine. It does not provide medical advice, diagnosis, or treatment, and it is not a substitute for the independent professional judgement of a licensed clinician.
Nothing on the Service establishes a physician–patient relationship. You must never rely on the Service to make a clinical decision about a real patient. Always verify against current primary literature, institutional protocols, drug labelling, and the judgement of a qualified supervising clinician.
Medicine changes. Guidelines, dosing, and standards of care are revised continually, and material on the Service may be out of date, incomplete, or incorrect at any given moment. You are responsible for verifying anything you intend to act on.
2. No patient information
Do not upload, post, or transmit protected health information or anything that identifies a real patient, including in comments, reports, flashcards, or messages to a tutor. De-identify any case material before it touches the Service. We may remove such content without notice and may suspend accounts that submit it repeatedly.
3. No affiliation with examination boards
Avarbock Med is an independent educational publisher. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to the National Board of Medical Examiners (NBME), the Federation of State Medical Boards (FSMB), the United States Medical Licensing Examination (USMLE) program, the Educational Commission for Foreign Medical Graduates (ECFMG), or any specialty certifying board.
USMLE® is a joint program of the FSMB and NBME. NBME® is a registered trademark of the National Board of Medical Examiners. All trademarks are the property of their respective owners and are used here only to describe the examinations our material is designed to support.
We do not guarantee any examination outcome.
4. Academic integrity
The Service contains original material written or reviewed by our editorial team. It does not contain, and we do not solicit, live or recalled examination questions.
You agree not to upload, post, or share recalled examination content, questions reproduced from any examination, or any material obtained in breach of an examination’s confidentiality agreement. Doing so may violate the rules of the examination body and may carry consequences for your candidacy that we cannot mitigate.
5. Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, to hold an account.
The Service is currently operated as a private pilot available by invitation only. Access is arranged through a tutor or directly by us, and we may decline or withdraw access at our discretion.
Your account is personal to you. Do not share your credentials or allow anyone else to use your account. You are responsible for activity under your account and for keeping your sign-in details secure. Tell us promptly at privacy@avarbockmed.com if you believe your account has been compromised.
6. Acceptable use
You agree not to:
- copy, scrape, download in bulk, republish, resell, or redistribute content from the Service, or use it to build a competing product;
- use automated means to access the Service except as we expressly permit;
- share, sublicense, or resell your access;
- attempt to breach or circumvent authentication, rate limits, or access controls, or access another user’s account or data;
- upload malicious code, or content that is unlawful, defamatory, harassing, or infringing;
- misrepresent your identity, credentials, or affiliation.
7. Your content
You retain ownership of content you create on the Service — comments, reports, flashcards you author, and notes. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display that content as needed to operate the Service.
You are responsible for what you post and confirm you have the right to post it. We may remove content that breaches these Terms.
8. Our content
All educational material, question banks, flashcards, layouts, designs, logos, and software on the Service are owned by Avarbock Med or its licensors and are protected by copyright and other intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own educational purposes. No other rights are granted. Institutional or group use requires a separate written agreement.
9. Tutoring services
Where tutoring is offered through the Service, tutors are independent educators providing academic instruction only. Tutoring does not constitute medical advice, clinical supervision, or supervision of patient care.
Scheduling, cancellation, prepaid-hour, and refund terms for tutoring are set out at the point of booking and form part of these Terms.
10. Fees
The Service is currently provided without charge during the pilot. We may introduce fees in future; if we do, we will give notice before any charge applies to you, and you may decline by discontinuing use.
11. Suspension and termination
You may stop using the Service and request deletion of your account at any time by contacting privacy@avarbockmed.com.
We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if we discontinue the Service. On termination, your licence to use the Service ends. Sections 1, 2, 3, 8, 12, 13, 14, and 15 survive.
12. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, or error-free, that content is accurate, current, or complete, or that any particular educational or examination result will follow from its use.
13. Limitation of liability
To the maximum extent permitted by law, Avarbock Med and its officers, employees, contributors, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of the Service.
In particular, and without limiting the above, we are not liable for any clinical decision, patient outcome, academic outcome, or examination result arising from reliance on material available through the Service.
Our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amount you paid us in the twelve months preceding the claim, or one hundred US dollars (US$100).
Some jurisdictions do not allow certain exclusions or limitations; where that is so, the exclusions and limitations above apply to the fullest extent permitted.
14. Indemnification
You agree to indemnify and hold harmless Avarbock Med and its officers, employees, contributors, and contractors from any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the Service, your content, or your breach of these Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in the State of Florida for any dispute not subject to another agreed process.
16. Changes to these Terms
We may revise these Terms from time to time. We will update the “Last updated” date and, for material changes, give notice through the Service or by email before they take effect. Continued use after a change takes effect means you accept the revised Terms.
